NOTICE OF PARKING CITATIONS (Violations)

School Year 2007-2008

Important Information for Parking Citation Contestants
(According to the California State Vehicle Code 2000 through the 1999 Legislative Session)

How much will a parking violation cost me?
Initial Review:
  Within 21 days after the issuance of the citation or within 14 days after the mailing of a Notice of Delinquent Parking Violation, a person (Contestant) who wishes to contest a citation should complete and submit a "Request for Parking Citation Appeal Form"*, which is available at the CSUN Parking Office, corner of Prairie St. and Darby St. (818) 677-2157. State of California Vehicle Section 40207.

  The Parking Office will have the citation reviewed and will notify the Contestant of the results by mail. You should receive a response to your appeal within 21 days of the filing of your paperwork. Your ticket automatically incurs late penalties after 21 days, so you must contact the Parking Office if you have not received a response to your appeal. You are still responsible for the citation, even if you do not receive the response form. If the citation is canceled, no further action is necessary by the Contestant. Any further inquiries about payment of a citation should be directed to the CSUN Parking Office Monday through Sunday (8:00am - 5:00pm), with extended hours on Tuesday & Thursday (8:00am - 7:00pm). If you receive your DMV registration and a citation from CSUN is listed, it is your responsibility to contact our office before your registration. Proof of payment will be required (i.e. a receipt or canceled check).

Request for Hearing:
  If the citation is not canceled, then the Contestant must deposit the full penalty amount within 21 calendar days of the mailing of the result. The Contestant may then request an Administrative Hearing on the citation before a Hearing Office designated by CSUN, by filing a written request in person or by mail. When a request is filed, the Appeals Coordinator will schedule a Hearing before the CSUN Hearing Office. The owner and/or drive may appear at the Hearing in person and may present witnesses. If a personal appearance is not feasible, the Contestant may obtain a Hearing on written record that includes any statements and relevant evidence the Contestant wishes to submit. The California Vehicle Code, Section 40215(b)(c) and the CSUN Hearing Manual govern Hearing proceedings. Both publications are available for review on campus as is the CSUN Policy Manual on the Use of Campus Facilities, which contains rules governing parking at CSUN.

Hearing and Appeals:
  When an in-person Hearing is held, the Contestant should bring his/her DMV registration, driver's license, and all other relevant documents and materials that he/she wishes to submit in evidence. There should also be one photocopy of each item to be retained with the Hearing file. A person other than the registered owner who appears to contest the citation must present evidence of authorization from the registered owner. The Hearing is a formal process, with testimony taken under oath and all proceedings tape-recorded in order to preserve the record for possible court review. Statements of witnesses who cannot appear in person should be prepared as sworn affidavits or declarations.

  After the Hearing is closed, the Hearing Officer will make a written determination and ruling. A copy will be delivered either in person or by mail to the Contestant. If the Hearing Officer's ruling is to cancel the citation, a refund order will be issued and is made without further action by the Contestant. If the Hearing Office upholds the citation, the Contestant has the right to appeal to Municipal Court. Court appeals may be filed in person at West Valley Ticket Office, 9425 Penfield Avenue, Chatsworth, CA 91311. Because of very short time limits, the Contestant who wished to appeal should file with the Court promptly upon receiving notice of an adverse decision.
