LEFT ARROW CONTRACTING OUT

When determining whether or not to contract work out, please ask yourself the following two questions:

  1. Are we hiring a CSU employee as an independent contractor?
  2. Did we review the Collective Bargaining Agreement?

If you answered Yes to number one (1), please note that the Public Contract Code restricts CSU employees (except people with teaching and research responsibilities) from contracting on his or her individual behalf as an independent contractor to provide services or goods. For more detailed information, please refer to the following link:

http://www.calstate.edu/HRAdm/pdf2003/HR2003-21.pdf

You may hire the CSU employee for additional employment. Additional employment is the term used to describe any employment compensated by the CSU, regardless of the source of funding, that is in addition to the primary or normal work assignment for which the individual is employed. The Additional Employment Policy establishes reasonable limits on the total amount of employment an individual may have with the CSU. This policy applies to the assignment of additional employment to CSU employees in any regular CSU program or auxiliary organization. For more detailed information, please refer to the following links:

http://www.calstate.edu/HRAdm/Policies/HR2002-05.pdf
http://www-admn.csun.edu/vp/policies/125_admn_fin/500/570_30.htm

If you answered No to number two (2), please note that CSUN may contract work out provided that the contracting out does not displace bargaining unit employees and the Collective Bargaining Agreement (CBAs) are followed, such as providing Notice to the Union. Employee Relations is responsible for providing notice. Please note that the Purchasing Department and Employee Relations are working together to ensure compliance. When in doubt, please contact Employee Relations for more information at x6566. For more detailed information, please review the Contracting Out Articles under relevant CBAs at the following link:
